These Terms and Conditions ("Terms") govern your access to and use of the Pass It On website located at passiton.uk ("Platform") and any related services operated by PassItOn Ltd ("we", "us", or "our"). By creating an account or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you and PassItOn Ltd. We recommend you save or print a copy for your records.

1. About the Platform

Pass It On is an online peer-to-peer marketplace that enables users to buy and sell second-hand sports equipment. We act solely as a platform connecting buyers and sellers. We are not a party to any transaction between users and we do not own, inspect, or guarantee any item listed on the Platform.

2. Eligibility and Account Registration

2.1 Eligibility

To use the Platform you must:

Be at least 18 years of age, or 16–17 years of age with verifiable parental or guardian consent;
Be resident in the United Kingdom or another jurisdiction where use of the Platform is lawful; and
Have the legal capacity to enter into a binding contract.

2.2 Account Creation

You must register an account to list items or make purchases. You agree to:

Provide accurate, current, and complete information during registration;
Keep your login credentials confidential and not share them with third parties;
Notify us immediately at passitonequipment@gmail.com if you suspect unauthorised use of your account; and
Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or permanently close accounts that are found to be inaccurate, fraudulent, or in breach of these Terms.

3. Listings

3.1 Seller Responsibilities

As a seller, you warrant that:

You are the legal owner of any item you list, or are authorised to sell it;
All listing descriptions, photographs, and stated conditions are accurate and not misleading;
The item is not stolen, counterfeit, or otherwise unlawfully obtained;
The item complies with all applicable safety standards and is legal to sell in the UK; and
You will fulfil any sale agreed through the Platform promptly and as described.

3.2 Prohibited Items

The following items must not be listed on the Platform:

Firearms, ammunition, or dangerous weapons (including bladed articles prohibited under UK law);
Counterfeit or replica branded goods;
Items that are unsafe, recalled by the manufacturer, or non-compliant with UK product safety regulations;
Stolen goods or items obtained through fraudulent means;
Any item whose sale is prohibited under UK law or regulation.

We reserve the right to remove any listing at our sole discretion without notice and to report suspected illegal activity to the relevant authorities.

3.3 Listing Accuracy

Sellers are solely responsible for the accuracy of their listings. Pass It On does not verify listings and accepts no liability for any inaccuracy, error, or omission in a listing.

4. Payments and Fees

4.1 Transaction Processing

All payments made through the Platform are processed by our third-party payment provider. By completing a purchase you agree to that provider's terms of service. Pass It On does not store payment card details on its servers.

4.2 Platform Fees

Pass It On may charge sellers a commission or listing fee on completed sales. Current fee rates are displayed on the Platform at the time of listing and are subject to change with reasonable notice. No fee is charged to buyers unless otherwise stated.

4.3 Pricing

Sellers set their own prices. All prices displayed on the Platform are in pounds sterling (GBP) and, where applicable, include VAT at the prevailing rate.

4.4 Failed or Disputed Payments

Pass It On accepts no responsibility for failed or declined payments. In the event of a payment dispute, users should contact their payment provider in the first instance. We will cooperate with investigations where required by law.

5. Disputes and Returns

5.1 Buyer and Seller Resolution

Pass It On encourages buyers and sellers to resolve disputes directly in the first instance. You can contact the other party through the Platform's messaging system.

5.2 Reporting a Dispute

If you are unable to resolve a dispute directly, you may report it to us at passitonequipment@gmail.com within 14 days of the transaction date. We will review the dispute and may, at our discretion, assist in facilitating a resolution. We are not obliged to resolve disputes and our involvement does not make us a party to the transaction.

5.3 Returns

Returns are subject to agreement between the buyer and seller. As a platform facilitating private sales, Pass It On is not responsible for arranging or funding returns. Sellers are encouraged to clearly state their returns policy within their listing.

5.4 Consumer Rights

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation.

6. Liability

6.1 Platform Availability

We aim to make the Platform available at all times but we do not guarantee uninterrupted or error-free access. We may suspend the Platform for maintenance or upgrade at any time without notice.

6.2 Limitation of Liability

To the fullest extent permitted by law, PassItOn Ltd shall not be liable for:

Any loss or damage arising from a transaction between users;
Any indirect, consequential, special, or punitive loss including loss of profits, data, or goodwill;
Any loss resulting from the actions or omissions of another user;
Any technical failure, interruption, or security breach of the Platform; or
Any loss arising from your reliance on information posted by another user.

Our total aggregate liability to you for any claim arising out of or in connection with these Terms shall not exceed the total fees paid by you to Pass It On in the 12 months preceding the claim.

6.3 Indemnity

You agree to indemnify and hold harmless PassItOn Ltd, its directors, employees, and agents from and against any claims, losses, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, your listings, or your breach of these Terms.

6.4 Fraud and Scams

Pass It On takes reasonable steps to detect and prevent fraudulent activity. However, users are responsible for exercising their own judgement before entering into any transaction. We strongly advise you to use the Platform's built-in payment and messaging systems and never to conduct transactions outside the Platform.

7. Intellectual Property

All intellectual property rights in the Platform, including its design, branding, software, and content created by us, belong to PassItOn Ltd. You must not reproduce, distribute, or create derivative works from our content without our prior written consent.

By uploading photographs or other content to the Platform, you grant PassItOn Ltd a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content solely for the purpose of operating and promoting the Platform.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, available at passiton.uk/privacy. By using the Platform, you consent to the collection and use of your personal data as described in that policy. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

9. Termination

We may suspend or terminate your account and access to the Platform at any time if we reasonably believe you have breached these Terms, acted fraudulently, or posed a risk to other users or to the Platform.

You may close your account at any time by contacting us at passitonequipment@gmail.com. Closure of your account does not affect any outstanding transactions or obligations.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by prominent notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection law requires otherwise.
